Terms of Service

By accessing or using Ernie ("the Service"), operated by All American Tradesman CE, LLC (d/b/a Ernie) ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using the Service.

These Terms apply to all users of the Service, including administrators, technicians, and any other individuals who access the Service on behalf of an organization. Your continued use of the Service following any changes to these Terms constitutes your acceptance of those changes.

Ernie is a field service management platform designed for pool service professionals. The Service includes route management, chemical logging, invoicing, customer management, technician dispatch, and related features.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must provide accurate, current, and complete information during registration and keep your account information updated. Accounts may not be shared or transferred without our prior written consent.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to transmit any content that is unlawful, harassing, defamatory, or otherwise objectionable, or to interfere with or disrupt the integrity or performance of the Service.

You may not attempt to gain unauthorized access to any part of the Service, reverse engineer the software, or use automated tools to scrape or extract data from the Service without our express written permission.

Access to certain features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, as selected during signup. All fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy.

We reserve the right to change our pricing at any time. Price changes will take effect at the start of your next billing cycle, and we will provide at least 30 days' notice before any price increase. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

The Service and its original content, features, and functionality are and will remain the exclusive property of All American Tradesman CE, LLC (d/b/a Ernie) and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of all data you submit to the Service. You grant us a limited, non-exclusive license to use, store, and process your data solely for the purpose of providing and improving the Service.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Any reliance you place on information obtained through the Service is strictly at your own risk.

To the fullest extent permitted by applicable law, All American Tradesman CE, LLC (d/b/a Ernie) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

You may cancel your account at any time through your account settings or by contacting our support team. We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms or if we reasonably believe your use of the Service poses a risk to us or other users.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination, during which time you may request an export. After this period, your data may be permanently deleted.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
